Dental Practice Information

On November 24, 1993, I completed construction on a new dental office and moved to that location.  At that time I contacted my licensing board (the Board of Dental Examiners of Alabama) to advise them of the move to my new location.  I asked if there was anything else I needed to do.  I was told, no.  So I felt at the time that I had complied with the necessary steps to change my office address.  Unfortunately, the DEA, a Federal agency, requires a practitioner to file for a modification of registration when changing office locations.  When this DEA registration error was discovered by me a few years later, I contacted the DEA and immediately corrected the error.  The DEA cleared the matter with no fines, penalties or sanctions.

Following this discovery and correction, I felt compelled as an honest practitioner to advise the AL Board of Dental Examiners (Board) of this clerical error, something that I was not required to do.   This call to the Board began a snowballing process that lead to major operational changes at the Board level, sanctions to my dental license, major changes to the AL Dental Practice Act, Board reform and resignations including the replacement of the Board attorney, replacement of the Board administrative secretary and the resignation of the Executive Director of the AL Dental Association.

So why did this become such a big deal with the Board?  At the time this clerical error occurred, the AL Dental Practice Act (the law that regulates the dental profession in AL) did not provide a provision for a clerical or administrative error.  The Board, by law, had no choice but to sanction my dental license.  Needless to say, the law did not intend to punish a clerical error in the same way it punished a criminally negligent practitioner who endangers their patients. 

With the help of other reform-minded dentists in AL, we set out to change that law.  As the leader of that grassroots organization, we aggressively fought many road blocks, bureaucracies and a stagnant legislative process.  But from sheer determination to do the right thing, we overcame personal attacks, intimidation and threats to successfully change the law to prevent such action from happening again to any other good dentist.  I am proud to be a part of those dentists that risked their livelihood to protect future dentists and the public.
